Portico Decking Problems Available To Be Reviewed by Attorneys

According to a Portico class action complaint, the manufacturer of the product, Fiberon, received a number of Portico decking complaints regarding the spotting. In response, the company told its customers to expend their own money to clean the decks with a chemical that did not work or appeared to work in part, only to have the mold growth return, the suit claims. Allegedly, the uniform spotting pattern cannot be prevented or remediated and can develop even if the product is properly maintained, installed and cleaned. It has been alleged that Fiberon has refused to pay for costs associated with cleaning the spots and does not replace the product or compensate consumers for replacement labor costs to remove the boards.

The Portico class action complaint claims that the company expressly warranted these products for 20 years and distinguished them from traditional wood decking products, which are difficult to maintain and can fade, crack or mold. Allegedly, Fiberon touted its decking products, equal parts polyethylene and wood fiber, as superior to natural wood decking, a product over which it commanded a premium price.
