San Diego Lemon Law Attorney Sues Team Kia Of El Cajon For Falsifying Down Payment Amounts

JKC Palm Springs Automotive, Inc., et al. (San Diego County Superior Court Case No. 37-2011-00071395) is venued in the El Cajon division of the San Diego County Superior Court. The defendant JKC Palm Springs Automotive, Inc. does business under a fictitious business name, and operates the El Cajon dealership “Team Kia of El Cajon” in El Cajon, California. The Plaintiffs, who are represented by California lemon law attorney Michael R. Vachon, Esq., are a local San Diego, California couple.

San Diego Lemon Law AttorneyÂ’s Complaint Against Team Kia of El Cajon

Although this lawsuit was filed on the plaintiffsÂ’ behalf by prominent San Diego lemon law lawyer Michael R. Vachon, Esq., the complaint against Team Kia of El Cajon alleges no California lemon law causes of action. Specifically, the Team Kia of El Cajon complaint alleges that when the Plaintiffs bought a 2011 Kia Sedona from Team Kia of El Cajon, the El Cajon dealership falsified the amount of the down payment that the Plaintiffs had immediately agreed to pay. The San Diego lemon law attorneyÂ’s complaint further alleges that Team Kia of El Cajon concealed the fact that Plaintiffs were making a deferred down payment in order to get the Plaintiffs qualified for a vehicle loan for which they otherwise would not have been eligible.

Although falsifying down amounts is not specifically prohibited by the California lemon law, the PlaintiffsÂ’ California lemon law attorney alleges that Team Kia of El CajonÂ’s conduct violates CaliforniaÂ’s Automobile Sales Finance Act, the Consumers Legal Remedies Act, and CaliforniaÂ’s Unfair Competition Law statute.

San Diego Lemon Law Attorney Alleges Team Kia of El Cajon Has an Illegal Practice of Falsifying Down Payment Amounts

California lemon law attorney Michael R. Vachon, Esq. complaint alleges that the Plaintiffs in this lawsuit are not the only victims of Team Kia of El CajonÂ’s conduct. Specifically, the San Diego lemon lawyerÂ’s complaint alleges that Team Kia of El Cajon has an illegal business practice of falsifying down payment amounts in order to get vehicle purchasers qualified for predatory loans for which they otherwise would not have been eligible. Accordingly, the Complaint against Team Kia of El Cajon seeks an injunction that would prevent Team Kia of El Cajon from falsifying down payment amounts in future transactions.

The power to issue an injunction against a car dealership is generally not available under the California lemon law, but is in this case a potential remedy based on the non-California lemon law statutes under which Plaintiffs sued.

The San Diego County Superior Court has not yet made any determination of whether or not Team Kia of El Cajon committed any wrongdoing, or of whether the allegations in San Diego lemon law attorney Michael R. Vachon, Esq.Â’s complaint have merit. Team Kia of El Cajon has denied all liability in this lawsuit, and asserted that it committed no wrongdoing.
