Trial Attorney Scott Borders Recovers $820,000 for Physician's Assistant Groped by Doctor

(EMAILWIRE.COM, February 04, 2012 ) Tampa, Florida – Morgan and Morgan is pleased to announce that a jury has handed down an $820,000 verdict to a client represented by trial attorney Scott T. Borders. In the case, Danielle Turner, a newly hired physician’s assistant, claimed that she was groped by Dr. Gunwant Dhaliwal at his walk-in clinic after he demonstrated a microdermabrasion on her. Over the course of two days in Sept. 2011, the jury decided that the client be awarded $700,000 in punitive damages, as well as $120,000 for pain and suffering.

Ms. Turner claimed that she went to DhaliwalÂ’s walk-in clinic after hours on Feb. 12, 2007 so he could provide training in microdermabrasion by performing the procedure on her. She alleged that after the procedure he applied lotion to her face and chest, and then groped her breasts underneath her shirt. Dhaliwal claimed that the incident did not happen, but Mr. Borders called upon a victim advocate who saw Ms. Turner after the incident and testified that her skin was raw and red. Jurors sided with Ms. Turner after deliberating for two hours and returned the next day for the punitive damages phase. Mr. Borders asked for a punitive damages award of $409,000, but the jury awarded well above the asking amount. The $700,000 punitive damages award is equally divided against the doctor and the corporation which owns the clinic.
