Southfield Estate Planning Attorney Prevents Family Fighting After Death

(EMAILWIRE.COM, August 25, 2010 ) Southfield, Michigan – The death of someone in Michigan who was near and dear can be a stressful time. Your life is disrupted by the loss and your grief. Often, it can be a confusing time, both emotionally and logistically.

In a recent article Advising the Trust or Estate Litigant: When to Raise or Fold, Chicago, Illinois attorney Howard M. Helsinger points out that “Estate and trust litigation is so often carried out in the context of grief, mourning, guilt, jealousy and anger; that it may be that irrationality is its dominant characteristic. Attorneys advising advising in such circumstances have an opportunity to temper those distortions....”

Some attorneys are not prepared to represent clients in an emotional state. At a recent Mega Conference, we asked famed Southfield Attorney and Probate Litigator why this is so. “Clients often have uncertainty regarding the process after death. And most true wills and trusts attorneys never litigate cases so they are not well prepared with the nuances of litigation, settlement of cases, trying will contests, joint bank accounts and a host of other types of trust and will contests.

“The irony is that most (if not all) Southfield, MI attorneys (and litigators) don’t know a lick of estate planning or probate process.” Mr. Dadich went on to state that “there are 3 strategies your wills and trusts lawyer may not know of:

“One, NEVER receive or accept any benefits from a loved one’s Trust or writing Will until talking with an attorney.

“Two, secure all bank statements (joint bank accounts also) and collectibles (if any).

“Three, determine who the Personal Representative is, or Trustee of a Trust.”
