(USGovernment-News.Com, September 11, 2013 ) ROGERS, AR — Oil giant ExxonMobil responded to formal complaints from the United States and the state of Arkansas requesting dismissal of the claims that the oil spilled by the Pegasus Pipeline rupture pervaded creek beds and caused harm to residents of Mayflower, AR.
Exxon maintains the state has not provided enough specific evidence to support their claims, and that they have not stated a claim, “upon which relief can be granted,” according to Attorney General Dustin McDaniel’s response to the case. The original complaint alleges six different counts for which the state is seeking civil penalties from Exxon.
Exxon claims that the state’s assertion of interference and degradation to the quality of life to the residents of Mayflower is unfounded, though Attorney General McDaniel notes that one could easily ask a homeowner in Mayflower whether this is true and they may agree that it is. The trial date for this case has been set for June 16, 2014.
