(USGovernment-News.Com, June 09, 2013 ) San Francisco, CA -- Scalia was at the end of a losing battle in which Supreme Court was decided whether or not DNA collection upon arrest was constitutional.
For an anecdotal for-for-thought, Sam Kamin, a University of Denver law professor, made that point in a conversation we had about the decision, which arose from the 2009 arrest of a Maryland man. Cops took DNA from a man named Alonzo Jay King Jr. after booking him for an assault charge. His DNA matched evidence from a 2003 rape, and he eventually was convicted of the rape.
The question the courts had to answer was whether the use of the DNA to nail him for the prior crime was a violation of Fourth Amendment protections against unreasonable searches. Assuming that King was also fingerprinted and photographed, that information is used to find out whether there are outstanding warrants and to solve crimes.
Mitch Morrissey, Denver's district attorney, mentioned that systems are being tested now that would allow DNA to be processed within 90 minutes of collection so that it could be used more broadly to identify people coming into a city jail.
That practice could eliminate some of the hundreds of mistaken identity arrests the city has been criticized and even sued over, and ultimately lower the rates of innocent people put in jail and prison for crimes they didn’t commit.
