New Law to Give 'Criminals' Clean Slate

(USGovernment-News.Com, June 07, 2013 ) London, UK -- There are likely to be an onslaught of requests by many looking to clear out old criminal records in the Indiana area, thanks to a new law passed.



The law is set to go into effect on July 1, and creates a mechanism for thousands within Indiana to remove non-violent crimes from their personal record. There are rules and caveats to removal rules; however, it is likely that thousands will be granted for those who seek a clean rap.



The law has a clear and established list of what crimes can be expunged, and perhaps more importantly, those that clearly are not up for removal. The law does, however, involve some gray area that could be sought for exploit by those who feel their crime is close enough to the criteria to be awarded expungement.



The process will not be a fast-paced one. It will take the efforts of all within the legal system to make the system work to remove those who need not be included on the list of criminals. It is likely to take considerable time before many of those seeking a clean sheet will even have an opportunity to see it.



“The law is incredibly broad,” said Republican Rep. Jud McMillin, a former deputy prosecutor from Brookville who authored the bill. “One of the first things I tell people: If you have a criminal record at all, you need to ask somebody if you’re eligible.”



An attorney is not the only one that can do so. Since the law is so new, however, and penalties can be levied for not getting it right are severe, McMillin are cautioning all to seek legal advice before attempting to putting a record up for review.



“It’s always suspect when a lawyer says to someone, ‘I wouldn’t try this on my own.’ But in this case, you really shouldn’t try this on your own,” said Republican Sen. Brent Steele, a Bedford attorney who carried the bill in the Senate.
