Overtime Settlement for Amerigroup Marketing Reps Announced by Morgan and Morgan

(EMAILWIRE.COM, April 03, 2012 ) Orlando, Florida – The wage and hour attorneys at Morgan and Morgan are pleased to announce that Amerigroup Corp. has agreed to pay $4.45 million to settle a class action brought by its New York marketing representatives. The lawsuit challenged Amerigroup’s position that its marketing representatives were not entitled to overtime wages when they worked more than 40 hours a week. In Nov. 2010, a proposed class action was filed against Amerigroup alleging that the company violated federal and state labor laws when it classified its marketing representatives nationwide as “outside salespeople,” who are exempt, or ineligible, to receive overtime pay. Amerigroup, which contracts with the government to offer managed healthcare to eligible individuals under Medicaid and Medicare, earns a government-paid commission for each member it enrolls, the suit claims. A similar case was filed several months later on behalf of New York-based marketing reps, which was then consolidated with the class action suit. Allegedly, the marketing reps were overworked and underpaid, tasked with recruiting 25 enrollees per week, and routinely worked more than 40 hours a week without time-and-a-half pay.

The overtime settlement covers more than 900 Medicaid marketing representatives who work or have worked in AmerigroupÂ’s New York-based offices between Nov. 2004 and present day.
