Enterprise Class Action Claims Customers Are Unlawfully Charged for Damaging Vehicles

The Enterprise lawsuit was filed by a Pittsburg resident on behalf of himself and those similarly situated. The suit alleges that the car rental company is violating California, Pennsylvania, New York and Illinois state law when it collects charges for repair costs and diminishment of value from customers who accidentally damage their rental cars. According to the Enterprise lawsuit, the proper measure of damages is to charge for the diminished value of the vehicle or the costs of repair, whichever is less. The lawsuit further claims that the car rental company is not only in violation of state law, but also its own contract, which does not allow for it to charge for both personal property damages. Instead, the Enterprise lawsuit claims, it only states that it may elect to levy those charges.
