Da Vinci Robot Lawsuit Trial Begins, As Southern Med LawÂ’s Dr. Francois Blaudeau Seeks $300 Million for Allegedly Botched Hysterectomy

(USGovernment-News.Com, April 09, 2016 ) Birmingham, AL -- A Da Vinci robot lawsuit product liability trial that began this week in California Superior Court is seeking $300 million on behalf of a woman who allegedly suffered serious internal injuries as a result of Intuitive Surgical, Inc.’s Da Vinci Surgical System. The Da Vinci robot lawsuit plaintiff, who underwent a hysterectomy with the robot in 2009, is being represented by Dr. Francois Blaudeau, the founder of Southern Med Law.

(Zarick v. Intuitive Surgical Inc., case number 1-12-CV-237723, in the Superior Court of Santa Clara County)

Bloomberg News Report Implicated The Da Vinci System In At Least 70 Patient Deaths

According to court documents, the Da Vinci Surgical System has been installed in more than 2,000 hospitals throughout the U.S., and is a popular choice for hysterectomies and other minimally-invasive surgeries. However, the Da Vinci robot lawsuit currently at trial asserts that the surgical robot has been the cause of numerous serious injuries, including some fatalities, due to alleged malfunctions of the machine. A Bloomberg News report published in October 2013 implicated the Da Vinci system in at least 70 patient deaths since 2009, and noted that injuries linked to robotic surgery had more than doubled in the first eight months of 2013.

Da Vinci Robot Lawsuit Asserts Complications Were The Result Of The Da Vinci’s Electrified Scissors

The Da Vinci robot lawsuit plaintiff at the center of the Da Vinci robot trial now taking place in California underwent a minimally invasive hysterectomy in 2009. Her Da Vinci robot lawsuit complaint charges that within weeks of the robotic procedure, the plaintiff’s intestines protruded through her vagina, requiring her to undergo an invasive emergency surgery. She asserts that her complications were the result of the Da Vinci’s electrified scissors, which she claims were not sufficiently insulated. As a result, electricity was able to surge through the instruments, causing injury to surrounding tissue, including the bowel. The Da Vinci robot lawsuit further alleges that Intuitive failed to adequately test the Da Vinci robot and withheld information about its risks from the U.S. Food & Drug Administration (FDA).
