IVC (inferior vena cava) filters are small, cage-like devices intended to be implanted in the inferior vena cava as a means of preventing pulmonary embolism. The Cook and Bard products at the center of the Firm’s IVC filter lawsuit investigation are meant for temporary placement, and are intended to be removed once the blood clot threat has passed. Since 2010, the U.S. Food & Drug Administration (FDA) has issued two public health alerts to remind doctors of the importance of IVC filter retrieval, as the risk of serious complications increases when the devices are allowed to remain in place longer than necessary.

C.R. Bard introduced the Recovery IVC filter in 2003, and replaced it with a slightly modified version called the G2 just two years later. In 2010, a study published in the Archives of Internal Medicine suggested the Bard Recovery filter failure rate was 25%, while the Bard G2 filter failure rate was around 12%. Currently, more than 50 IVC filter lawsuits involving the two Bard devices are pending in a multidistrict litigation underway in the U.S. District Court, District of Arizona. (MDL No. 2641)

In 2012, a paper published in CardioVascular and Interventional Radiology suggested that all Cook Celect and Gunther Tulip filters showed some degree of vena cava perforation after just 71 days. In 86% of the cases, the researchers observed full perforation of at least one component all the way through the IVC wall. The filters were found to have tilted in 40% of cases. In October 2014, all federally-filed Cook IVC filter lawsuits were centralized in a multidistrict litigation that is now underway in the U.S. District Court, Southern District of Indiana.
