Fleet Company, Inc. on behalf of a Pennsylvania man who allegedly experienced acute renal failure due to the Defendant’s Fleet Saline Enema product. The Fleet Enema Lawsuit, which was filed on July 14th in the U.S. District Court, Eastern District of Pennsylvania, alleges that C.B. Fleet failed to warn consumers about the potentially severe side effects associated with its saline enema products.
Fleet Enema Lawsuit Due To Acute Renal Failure
According to the Fleet Enema lawsuit complaint, the C.B. Fleet Company’s Fleet saline enema product is marketed as a laxative for the relief of occasional constipation. In June 2013, the 58-year-old Plaintiff purchased the product with the intention of gaining relief from constipation. Shortly after using the saline enema, he felt lethargic, weak and was diagnosed with acute renal failure. In July 2013, the Plaintiff’s doctors informed him that the renal failure he experienced was caused by the Fleet enema.
Among other things, the Fleet enema lawsuit claims that C.B. Fleet failed to provide adequate warnings in regards to the product’s potential association with kidney damage and renal failure at the time that it was used by the Plaintiff. Moreover, at the time of purchase, the product’s label indicated that its use was contraindicated in persons 65 and older without prior consultation with a physician. At some point after the Plaintiff used the Fleet enema, the contraindication was changed to 55 and older. In addition, the complaint points out that the U.S. Food & Drug Administration warned of the potential for serious kidney injury from the use of saline enemas just six months after his Fleet enema purchase.
The lawsuit further claims that the C.B. Fleet Company failed to conduct reliable tests to determine the product’s safety as a laxative or bowel cleanser, provide proper instructions on dosing and required hydration, or accompany the product with information that alternative bowel cleansing products may be more effective and safer. The complaints seeks damages for the Plaintiff’s continued permanent pain, emotional distress, medical expenses, lost wages, loss of earning capacity and loss of enjoyment in life
