Power Morcellation Surgery

As stated in court documents and the U.S. Food and Drug Administration (FDA), a laparoscopic power morcellator is a tool used to cut uterine tissue and fibroids into pieces so the fragments can be removed through a small incision in the abdomen. Court documents indicate that the FDA’s review of literature on power morcellation led the agency to conclude that the prevalence of unsuspected uterine sarcoma in patients undergoing hysterectomy or myomectomy (removal of fibrodis) for presumed benign leiomyoma is 1 in 352 and the prevalence of unsuspected uterine leiomyosarcoma is 1 in 498. According to court records and the FDA, leiomyosarcoma is a rare and aggressive form of soft tissue cancer involving smooth muscle cells in the uterine and gastrointestinal areas. The law firm reports that in the FDA in November 2014 warned against using laparoscopic power morcellators for the vast majority of women who require a hysterectomy or fibroid removal surgery, including those who are going through menopause, about to enter menopause, or those who are good candidates for minimally invasive procedures that do not require the use of power morcellators.

Power Morcellator Lawsuit Claim

Court documents indicate that power morcellation complaints being filed nationwide, including the case in which Southern Med Law is involved, allege that power morcellation manufacturers should have known about the cancer risks and the adverse events associated with their devices. According to court documents, the morcellation complaints accuse power morcellator makers of failing to warn physicians and their patients that morcellator use increases the possibility of disseminating undetected cancer cells throughout a woman’s body.
